Plattform Aspen Holding: BaFin ordnet Einstellung des grenzüberschreitenden Eigenhandels an
Die BaFin hat gegenüber der Next Trade Ltd., Vanuatu, mit Bescheid vom 30. Juli 2019 die sofortige Einstellung des grenzüberschreitenden Eigenhandels angeordnet.

Das Unternehmen bietet deutschen Kunden auf den von ihm betriebenen Handelsplattformen www.aspenholding.com und www.olympusmarkets.com finanzielle Differenzkontrakte (Contracts for Difference – CFD) an, die auf Grundwerte wie Rohstoffe, Indizes, Aktien sowie Währungen laufen.

Damit betreibt das Unternehmen gewerbsmäßig den Eigenhandel nach § 1 Absatz 1a Satz 1 Nr. 4 lit. c Kreditwesengesetz (KWG), ohne über die nach § 32 Absatz 1 KWG erforderliche Erlaubnis der BaFin zu verfügen. Es handelt daher unerlaubt.

Die zeitweise als Betreiberin der Plattform angegebene TLC Consulting Ltd, Majuro, Marshallinseln, hat ebenfalls keine Erlaubnis der BaFin.

Derzeit tritt eine Vielzahl von potenziell unseriösen Handelsplattformen an den Markt heran. Bei einigen besteht auch der Verdacht der organisierten Kriminalität.

Vor der Plattform Olympus Markets hat die BaFin bereits gewarnt. Zudem veröffentlicht die BaFin auf ihrer Webseite weitere Informationen zu unerlaubt betriebenen Geschäften einzelner Handelsplattformen.

Consob has ordered the black-out of 6 websites that offer financial services illegally.

The commission availed itself of the powers resulting from the ‘Decreto Crescita’ (‘Growth Decree’; Law no. 58 of 28 June 2019, article 36, paragraph 2-terdecies), on the basis of which Consob can order internet access providers to block access from Italy to websites offering financial services without the proper authorisation.

Next Trade Ltd e TLC Consulting Ltd (https://aspenholding.co and https://aspen-holding.com);

London Capital Trade Ltd (www.londoncapitaltrade.net).
The measures with which the aforementioned companies were ordered to terminate the abusive activity can be viewed on the website www.consob.it.

The black-out of these websites by internet access providers operating on the Italian market is ongoing. For technical reasons, it can take several days for the black-out to come into effect.

CNMV ISSUES WARNING TO THE PUBLIC ON UNREGISTERED FIRM

Pursuant to the second paragraph of Article 17 of the Securities Markets Law (recast text approved by
Royal Legislative Decree 4/2015, of 23 October), the Comisión Nacional del Mercado de Valores (National
Securities Market Commission) warns that:

is not authorised to provide the investment services detailed in Article 140 of the Securities Markets
Law, which include investment advice, or to provide the auxiliary services detailed in letters a), b), d),
f) and g) of Article 141 of the said Law in relation to the financial instruments detailed in Article 2 of the
said Law, including, for those purposes, foreign currency transactions.
